HENDERSON, Nevada (January 17, 2024) – Darryl Smith, the man facing multiple DUI and reckless driving charges in connection with a fatal crash on January 7th, appeared in a Henderson courtroom Wednesday morning, where his bail was kept at $255,000.
The crash, which occurred near Lake Mead Parkway and Grand Cadence Drive, tragically claimed the lives of 38-year-old Rebecca Post and her two young sons, 6-year-old Achilles Quintanilla and 5-year-old Leo Post-Quintanilla.
During the hearing, the state argued for an increase in Smith’s bail, citing the severity of the charges and the potential flight risk he poses. The defense, on the other hand, requested Smith’s release under his own recognizance or a significant reduction in bail.
Judge Finds Clear Evidence of Flight Risk and Danger to Community
Ultimately, the judge sided with the state, finding clear and convincing evidence that Smith is both a flight risk and a danger to the community. This decision was likely influenced by details in the police report, which states that Smith allegedly admitted to consuming alcohol and cough syrup prior to the crash.
Strict Conditions for Potential Release
If Smith manages to post his $255,000 bail, he will be released under strict conditions. These include level three PCU monitoring, scram alcohol monitoring, and a complete ban on driving, alcohol, and drug use, including cough syrup. As of Wednesday afternoon, records show that Smith has not yet posted bail.
Ongoing Investigation and Grieving Community
The investigation into the crash is ongoing, and the Henderson community continues to mourn the tragic loss of Rebecca Post and her two young sons. This case serves as a stark reminder of the devastating consequences of driving under the influence.
