SPARKS, Nev. (775 Times, NV Globe) – In accordance with the recently passed domestic battery in the presence of a kid statute, the City of Sparks has announced its first conviction of a man.
Everett Eugene Palo Trahey was found guilty on one count of domestic battery in the presence of a child and one count of domestic battery, first offense.
On Oct. 22, the Sparks Police Department was called in response to complaints of a domestic disturbance. When authorities arrived, a female victim informed them Trahey started arguing with her before throwing her to the ground and repeatedly punching her in the face. Their three-year-old kid saw the fight.
“In keeping with our zero-tolerance policy in the fight against domestic violence, we will continue to use all tools available to hold abusers accountable and protect children. This sentence should serve as a sign that we will continue to aggressively prosecute domestic battery related offenses, especially when the involve children,” said City Attorney Wes Duncan.
The City Council amended the Sparks Municipal Code in October to include the offenses of battery in the presence of a child, domestic violence in the presence of a child, and abuse, neglect, or endangerment.
Trahey was sentenced to 150 days in the Washoe County Jail and 30 days suspended in exchange for completing 48 hours of community service for his conviction of Domestic Battery.
He must also attend 26 weeks of domestic violence treatment, pay a $200 fine, extra court penalties and assessments, a $35 Domestic Violence charge, take a parenting class on the impacts of domestic violence, submit to random drug and alcohol testing, and have no contact with the listed victim.
Trahey was sentenced to 180 days in the Washoe County Jail for domestic battery in the presence of a child, which was suspended for two years under the same terms as the domestic battery charge.
