This is Part 4 of our seven-part series, Nevada’s Witch Hunt: How Six Patriots Are Being Crucified for Defending Democracy. We’ve covered the Hawaii precedent, the electors’ clean hands, and their First Amendment rights. Now, let’s get to the juicy part: how Aaron Ford’s venue-shopping antics and shady tactics turned this case into a textbook example of prosecutorial misconduct. Grab some popcorn, this is a doozy.
Rewind to December 2023. Ford, Nevada’s AG, files felony charges against six electors in Clark County, a Democrat stronghold where Biden voters outnumber Trump’s by a mile. Problem is, the alleged “crime”, signing and mailing contingent Trump votes, happened in Carson City and Douglas County. Clark County’s connection? Zilch, nada, bupkis. Judge Mary Kay Holthus saw through the charade, tossing the case in June 2024 for improper venue, citing a 2021 Nevada Supreme Court ruling that venue must tie to the crime’s core elements. Ford’s response? Appeal to the Supreme Court and refile in Carson City, right as he announces his 2026 governor run. Subtle as a sledgehammer.
Legal Argument for Dismissal: Improper Venue and Prosecutorial Misconduct: Ford’s Clark County gambit was a naked attempt to stack the jury pool with Democrats, a move so blatant it’s practically a PowerPoint on “How to Abuse Prosecutorial Power.” The venue dismissal was legally sound, the electors’ actions didn’t touch Clark County. Refiling in Carson City, while technically proper, smells like a desperate hedge, especially with Ford’s campaign announcement. Defense attorneys also allege Ford withheld exculpatory evidence from the grand jury, like communications proving the electors’ good faith, violating Brady v. Maryland (373 U.S. 83). This isn’t law enforcement; it’s political theater, and the electors are paying the price with crippling legal bills.
Ford’s playing a dangerous game, weaponizing the system to crush dissent. Part 5 will unravel how Nevada’s vague laws gave the electors no fair warning, making this prosecution a due process disaster. Stay tuned.
