You’ve got lawsuits pending, campaign lawyers nodding, and a sense of duty to keep the electoral door open. Then, bam, three years later, Aaron Ford hits you with felonies for “forgery.” You check Nevada’s laws, and guess what? They don’t even mention alternate slates. Ford himself told the Nevada Legislature in May 2023 that state statutes “did not directly address” the electors’ conduct. Yet, he charged them anyway, because nothing says “justice” like making it up as you go.
Legal Argument for Dismissal: Statutory Ambiguity and Fair Notice: The Due Process Clause demands clear laws so citizens know what’s illegal (United States v. Lanier, 520 U.S. 259). Nevada’s election code is silent on contingent electors, and Ford admitted it. Charging them under forgery statutes (NRS 205.110, 239.330), meant for fake checks, not political acts, is like jailing someone for jaywalking on a highway with no signs. The electors had no reason to think their actions, backed by precedent, were criminal. This ex post facto punishment violates basic fairness, turning a legal gray area into a guillotine.
Ford’s lawfare is bleeding these electors dry, their legal fees skyrocketing while he grandstands for votes. This isn’t about justice; it’s about power.
