Lombardo Wins Big: Nevada High Court Upholds Governor’s Right to Challenge Ethics Gag

Governor Joe Lombardo has won a decisive victory in Nevada’s highest court, as the Supreme Court unanimously ruled that his lawsuit challenging an ethics commission fine can proceed  . The case was sent back to the lower Carson City court after the Supreme Court found that Lombardo’s delay in notifying the Attorney General did not prejudice the commission, especially since the AG had recused itself due to a conflict of interest  .

This legal battle centers on a $20,000 fine and formal censure imposed by the Nevada Commission on Ethics in 2023. The commission accused Lombardo, formerly Clark County Sheriff, of improperly using his official badge and uniform in campaign materials, a move he argues violated Nevada’s constitutional separation of powers, given that the legislature appoints half of the ethics commissioners  .

This ruling isn’t a pardon—it simply reopens the debate over whether the ethics commission overstepped its authority. The court’s decision respects core principles like procedural fairness, the integrity of campaign speech, and the limits of government power. It underscores the tension between holding public leaders accountable and preserving their constitutional rights to seek office without undue bureaucratic interference.
