Attorneys for Daniel Rodimer Seek Dismissal of Murder Case, Citing Improper Police Recordings

LAS VEGAS, NV — Legal counsel for Daniel Rodimer, the former professional wrestler and Republican congressional candidate accused of murder, filed a motion on Monday to dismiss all charges against him. The motion alleges that the Las Vegas Metropolitan Police Department (LVMPD) improperly intercepted and recorded confidential communications between Rodimer and a prominent defense attorney.
Allegations of Constitutional Violation
Rodimer’s attorneys argue that the recordings constitute a “gross violation” of his Sixth Amendment right to counsel.
-
Privileged Communications: The motion claims that Metro police recorded conversations that should have been protected by attorney-client privilege during the initial stages of the investigation.
-
The Defense Argument: David Chesnoff and Richard Schonfeld, Rodimer’s lead attorneys, state that the prosecution’s case has been “irreparably tainted” by the acquisition of this privileged information.
The Case Background
Rodimer is currently facing an open murder charge in connection with the October 2023 death of 38-year-old Christopher Tapp at a Las Vegas Strip resort.
-
The Incident: Tapp was found with severe head injuries in a hotel room and later died at a local hospital; the coroner subsequently ruled the death a homicide caused by blunt force trauma.
-
The Allegation: Prosecutors allege that Rodimer struck Tapp during an altercation over a dispute involving drugs.
Next Steps
The Clark County District Attorney’s office has not yet filed a formal response to the motion to dismiss. A hearing to address the allegations of improper recording is expected to be scheduled in the coming weeks. Rodimer remains out of custody on a $200,000 bond.
