Part 6 of 7: Statute of Limitations Shenanigans, Ford’s Desperate Endgame

This is Part 6 of our seven-part series, Nevada’s Witch Hunt: How Six Patriots Are Being Crucified for Defending Democracy. We’ve peeled back layers of Aaron Ford’s crusade against six Nevadans, from ignoring precedent to weaponizing vague laws. Now, let’s talk about Ford’s latest trick: dodging the statute of limitations to keep this persecution alive. It’s like watching a magician pull a rabbit out of a hat, except the rabbit is justice, and it’s been clubbed senseless.

Here’s the deal: Ford’s original charges, filed in Clark County in December 2023, included offering a false instrument (NRS 239.330), which has a three-year statute of limitations, expiring December 2023. When Judge Holthus tossed the case for improper venue, Ford appealed to the Nevada Supreme Court, set for August 2025. But, knowing time was up on one charge, he refiled the other, uttering a forged instrument (NRS 205.110), in Carson City in December 2024, no time limit on that one. Oh, and he announced his governor run the same day. Classy. Defense attorneys call this a “dead case” revived by loophole, and they’re not wrong.

Legal Argument for Dismissal: Statute of Limitations Bars Refiling: The Clark County dismissal should’ve ended this farce, but Ford’s Carson City refiling is a Hail Mary to skirt the expired limitation on the false-instrument charge. While forgery technically has no time bar, refiling after a venue dismissal smacks of bad faith, especially with Ford’s political posturing. The Nevada Supreme Court’s pending review could affirm the original dismissal, mooting the new case. Double-dipping prosecutions waste resources and punish the electors, whose legal bills are now in the hundreds of thousands, for a non-crime.
