Charges Dismissed Against Former Mental Health Tech Accused of Lewd Conduct

Las Vegas, NV — Charges against Donovan Dykes, a former mental health technician accused of inappropriately touching a child patient, have been dismissed, according to his attorney and court records.
Dykes, who faced accusations of lewdness in the presence of a child and abuse or neglect of a child mental health patient, was cleared of all charges on November 12, as per court docket records.
The allegations stemmed from an incident on February 14 at Desert Winds Hospital, where Dykes was accused of inappropriately touching a patient. According to an arrest report, the alleged victim claimed Dykes “grabbed her breast with his bare hand over her clothing.”
Joshua Tomsheck, Dykes’ attorney, stated that his client has been “completely exonerated” and described the allegations as “inaccurate.”
“There is simply no question that Mr. Dykes committed no crime or wrongdoing,” Tomsheck said. “The erroneous allegations occurred in the open, in front of witnesses, and on video. This evidence all shows Donovan is completely innocent.”
Desert Winds Hospital previously confirmed that Dykes was “immediately terminated” following the allegations. However, Tomsheck noted that the dismissal of charges affirms his client’s innocence and expressed confidence that the evidence would exonerate Dykes.
The Clark County district attorney’s office did not immediately respond to requests for comment.
Dykes, who had built his career in mental health care, is relieved by the dismissal and plans to move forward. “He is eager to put this behind him and continue pursuing the work he is passionate about,” Tomsheck added.
The case highlights the importance of thorough investigations and evidence review in sensitive allegations, particularly those involving mental health care professionals.
