Nevada’s Top Federal Prosecutor Under Fire After DOJ Workaround Expires

In a bold affront to constitutional norms, the Nevada federal public defender’s office is now challenging Acting U.S. Attorney Sigal Chattah’s authority—arguing that her appointment expired under the law back in July. This comes on the heels of a similar ruling in New Jersey, where a judge deemed Trump-appointed interim prosecutor Alina Habba’s tenure illegal. Yet the Justice Department pressed on with political maneuvering, sidestepping Senate confirmation by shuffling role titles—from interim to first assistant to acting. If unchallenged, this trend sets a dangerous precedent: the executive branch effectively circumventing legislative oversight and packing federal justice roles with partisan loyalists. As the defenders rightly argue, preserving the rule of law means demanding only lawful appointments—and ensuring justice remains blind, not politically pliable.
