Nevada GOP, RNC and Trump Campaign Sue Nevada Over Non-Citizen Voting
According to the complaint, the plaintiffs have discovered evidence of thousands of non-citizens on Nevada’s voter rolls who may be able to cast ballots in the upcoming November election

This morning, the NV GOP, RNC, the Trump campaign and a republican voter sued Nevada Secretary of State Francisco Aguilar, the Democratic National Committee and the Nevada Democratic party for illegally allowing non-citizens to register to vote and influence Silver State elections. Under Nevada law, only United States citizens are eligible to vote in Nevada elections.
The plaintiffs charge: “Francisco Aguilar, the current Secretary of State, is failing in his list-maintenance and investigatory duties to ensure that only U.S. citizens are registered and voting in Nevada elections.”
Adding “The Secretary thus has a duty to ensure that the statewide voter registration list includes only U.S. citizens. The Secretary also has a duty to “regularly maintain the voter-registration list to ensure the integrity of the registration process and the election process. NRS 293.675(3)(i).”
According to the complaint, the plaintiffs have discovered evidence of thousands of non-citizens on Nevada’s voter rolls who may be able to cast ballots in the upcoming November election.
Using data from the 2020 election, the plaintiffs contend that 6,360 individuals listed in the DMV’s non-citizen file were also registered to vote, and 3,987 of these individuals cast a ballot in the 2020 election.
Additionally, data reveals there are likely more than 11,000 non-citizens registered to vote in the state, and it is estimated that more than 3,700 non-citizens could cast a ballot in the 2024 presidential election.
RNC Chairman Michael Whatley stated: “Allowing non-citizens to vote suppresses legal voters, undermines the democratic system, and violates the law. Democrats continue to put non-citizens first and Americans last as they allow non-citizens to vote and interfere in American elections. We have filed suit in Nevada to protect the vote and stop this Democrat election interference scheme.”
NVGOP Chairman Michael McDonald stated: “Nevada’s elections should be a reflection of its citizens’ voices, not influenced by non-citizens who have no legal standing to participate. Any efforts to allow non-citizens to vote threatens the very foundation of our elections and diminishes the power of lawful voters across our state. This isn’t just a legal issue—it’s about protecting the rights of Nevadans and preserving the integrity of our elections.”
The RNC’s Election Integrity Department has led several ongoing election integrity lawsuits in Nevada.
In March, the RNC and the Nevada GOP filed a lawsuit alleging five Nevada counties are violating the National Voting Rights Act (NVRA) by not maintaining clean and accurate voter rolls. Judge Christina Silva also determined the plaintiff’s did not have standing, but fell short of dismissing the complaint. The RNC has vowed to “use every legal avenue to fight the decision.”
In May, the RNC, Trump campaign and Nevada GOP filed a lawsuit challenging Nevada’s acceptance of mail ballots up to four days after Election Day, including unreadable postmarks received up to three days after Election Day, alleging that the counting of ballots after Election Day violates federal election laws established by Congress. The case is currently under appeal.
During the last legislative session, Deputy Secretary of State for Elections Mark Wlaschin testified that non-postmarked ballots received after Election Day are counted in Nevada. Citing his testimony, the RNC filed a lawsuit June alleging that election officials were violating state law. In July, Chief U.S. District Court Judge Miranda Du dismissed the case on the grounds that the plaintiffs did not have standing to file the lawsuit. The RNC has appealed her decision.

No surprise here. Just about anything that Democrat Aquilar touches is plagued with incompetence or worse perhaps corruption. To be fair though, the voter rolls were inherited by Aguilar from his predecessor Republican Barbara Cegavske. So maybe this is just another great example of bloated government bureaucracy not doing their jobs yet getting away with it.
