Federal Preemption Clash Over Voter Data

The dispute centers on federal demands for raw voter registration files to audit Nevada’s voter list maintenance under the National Voter Registration Act (NVRA) and the Help America Vote Act (HAVA).

A federal judge in Nevada previously dismissed the DOJ’s civil lawsuit, ruling that the government had failed to establish sufficient “basis and purpose” under federal civil rights laws to force the disclosure of private identifiers shielded by Nevada state law.

Federal attorneys, however, maintain that federal election oversight authority preempts state-level privacy statutes.

The DOJ’s follow-up subpoenas arrived shortly after Aguilar’s office completed routine list maintenance that reclassified approximately 400,000 voter records as inactive, shrinking the registered Democratic advantage in Nevada to 672 voters.

Aguilar Pushes Back as November Election Looms

Aguilar confirmed that his office received the federal demands and has notified county election clerks to hold pertinent files through the appeal process. However, he strongly criticized the timing and tone of the federal probe.

“From a legal standard, we absolutely have to comply with that part of the letter, and we will — and we have,” Aguilar said, while characterizing the investigation letter as an intimidation tactic. “We will continue to make sure that we are not handing over information that does not need to be given.”

The DOJ’s appeal remains pending before the U.S. Court of Appeals for the Ninth Circuit.
