Abortion Is Settled Law In Nevada

Only the people of Nevada, not the Governor or Legislature, can change the law

By Mark Robertson, September 7, 2022 1:13 pm

Last week I spoke at the Women’s Chamber of Commerce in Las Vegas. After my comments, people were invited to ask questions. One woman said, “We should have a statute in Nevada protecting a woman’s right to have an abortion.” I was a little surprised that she didn’t know that Nevada does have just such a law.  Here was my response:

“Nevada does have a statute giving women the right to an abortion. In fact, it was passed by a referendum of the people. This means the law cannot be overturned by the Governor or by the legislature. Only the people of Nevada can change it. In Nevada, women may have an abortion, for any reason or no reason at all, through the 24th week of pregnancy. Even after that, they can have an abortion to protect the life and health of the mother. Nevada is a pro-choice State.”

Upon further reflection, I wish I had said more about abortion in Nevada. I wish I had also said:

I am unapologetically pro-life. I think we should protect the life of an unborn child. I believe a woman should have a choice whether she engages in activities that can lead to pregnancy. When a woman doesn’t have a choice, such as in the case of rape or incest, then I support an exception. I also support exceptions to protect the life and health of the mother.

Like 71 percent of Americans, the people of Nevada think there should be limits on abortion. In Nevada, those limits are 24 weeks and then the life and health of the mother. Five members of Nevada’s delegation to Congress are ignoring the will of the people. Each of them voted to remove all limits. They voted to allow abortion up until the very day of delivery in the 9th month of pregnancy.

That’s not all.

They voted to have the government pay for these unlimited abortions. That’s right, they took the extreme position that the 71 percent of Americans, who believe we should have limits on abortion, should be forced to pay for unlimited abortions.

Here are the names of the members of Nevada’s Congressional delegation who ignored the will of the people and who voted for the most extreme abortion bill possible: Senator Catherine Cortez Masto, Senator Jacky Rosen, Congresswoman Dina Titus, Congresswoman Susie Lee, and Congressman Steven Horsford.

I support the Supreme Court’s decision to overturn Roe vs Wade, not just because I’m pro-life, but because it is the correct legal decision. Even Justice Ruth Bader Ginsburg stated the Roe decision was on shaky legal ground. There is nothing in the Constitution guaranteeing a right to abortion.

The U.S. Constitution gives very limited powers to the Federal government. All other power is granted to the States and to “We, the people.” It is appropriate that the Supreme Court returned the question of abortion back to the States and to the people. It is disappointing that five of our Representatives in Congress are willfully ignoring the will of the people by taking such an extreme position on abortion.

In the coming days leading up to the mid-term elections, you will hear these five members of Congress talking about abortion. They will bring it up because they don’t want you thinking about inflation, about the border crisis, about crime, or about our failing schools.

Remember, the people of Nevada have already spoken on abortion – it is settled law. When career politicians in Nevada bring up abortion, they are just trying to divert your attention from their disastrous policies which have devastated our economy.  Don’t let them get away with it.
